Understanding Customs (Finalisation of Provisional Assessment) Regulations, 2025

The Central Board of Indirect Taxes and Customs (CBIC) has introduced a major reform with the Customs (Finalisation of Provisional Assessment) Regulations, 2025, replacing the 2018 framework. These reforms aim to bring clarity, accountability, and transparency to the process of provisional assessments under Section 18 of the Customs Act, 1962.

Provisional assessment allows goods to be cleared even when all details (like test reports or documents) are not available. However, in the past, the process often faced long delays, creating uncertainty for businesses.

The 2025 regulations address this by defining clear timelines and procedures.

Key Highlights of the 2025 Regulations

  1. Time-bound process:
    • Customs must request missing documents within 15 days.
    • Importers/exporters get 2 months (extendable to 4 months) to submit info.
    • Enquiries must close within 14 months.
    • Assessments to be finalised within 3 months after info/enquiry completion.
    • Maximum 2 years allowed (with extension in special cases).
  2. Pending cases addressed:
    • All cases pending as of 29 March 2025 must be resolved by 29 May 2026.
  3. Voluntary payments:
    • Importers/exporters may pay duty during the provisional stage, adjusted at finalisation.
  4. Speaking orders mandatory:
    • If the final assessment differs, Customs must issue a reasoned order following principles of natural justice.
  5. Refunds & securities:
    • Excess duties refunded promptly.
    • Bonds & securities released once assessments are finalised.
